The U.S. Court of Appeals for the Federal Circuit sent its strongest signal yet Monday that it will give the Patent Trial and Appeal Board wide leeway to manage the postgrant review process—except, perhaps, when it comes to claim construction.
In separate rulings the court declined to second-guess a PTAB decision to terminate a case two months after the institution of proceedings, and blessed the PTAB’s rationale for refusing to allow a claim amendment.
