“Fed. Circ. Affirms PTAB’s Invalidation Of Graphite Patents,” Law360, June 17, 2016

Law360, New York (June 17, 2016, 5:39 PM ET) — The Federal Circuit on Friday affirmed the Patent Trial and Appeal Board’s decision that Laird Technologies Inc. had shown that three GrafTech International Holdings Inc. patents on using graphite to dissipate heat from electronic components were invalid as obvious.

“The Federal Circuit’s decision is the validation of a less prominent use of inter partes review – elimination of weak patents that are not the subject of litigation,” Matthew Cutler, attorney for Laird, told Law360. “Too often, weak patents are used in the marketplace to stifle competition and inter partes review is now a proven mechanism for eliminating those patents outside of the district courts.”
